Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and the operator of Paideia Live (“Paideia Live,” “we,” “us,” or “our”) governing your access to and use of Paideia Live and any related websites, applications, content, and services (collectively, the “Service”). Please read them carefully. By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

2. The Service

Paideia Live is a subscription-based digital reading program that provides access to curated readings, original commentary, audio, an AI-assisted tutor, and related features. The specific texts, features, pairings, and content included in the Service may change, be added to, or be removed at any time. We do not guarantee that any particular text, feature, or piece of content will remain available.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account. Accounts are personal to you and may not be shared, sold, or transferred.

4. Subscriptions, Billing, and Renewal

The Service is offered on a recurring subscription basis (for example, monthly or annual plans). By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis for the plan you select, including applicable taxes, until you cancel.

Automatic renewal. Your subscription renews automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date. You authorize these recurring charges without requiring further approval for each renewal.

Price changes. We may change subscription prices from time to time. Any price change will apply to billing periods after we provide notice to you, and your continued use of the Service after a price change takes effect constitutes acceptance of the new price.

Payments are processed by a third-party payment processor. We do not store your full payment card details.

5. Free Trial

We may offer a free trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged at the then-current rate. Free trials are limited to one per person and may not be combined with other offers. We reserve the right to modify or withdraw free-trial offers at any time.

6. No Refunds; All Sales Final

All payments are final and non-refundable. Except where a refund is required by applicable law, we do not provide refunds or credits for any reason, including for partially used or unused subscription periods, features you did not use, content you found unsatisfactory, dissatisfaction with the Service, or your failure to cancel before a renewal.

When you cancel, your cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date, and you will not be charged for subsequent periods. We do not provide prorated or partial-period refunds.

Any refund, credit, or other accommodation that we may choose to provide in an individual case is made at our sole discretion, does not create any obligation or expectation for the future, and does not waive this policy. Initiating a chargeback or payment dispute instead of contacting us may result in immediate suspension or termination of your account.

7. Cancellation and Termination

You may cancel your subscription at any time through your account settings or billing portal; cancellation takes effect as described in Section 6. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if we suspect fraud or abuse, or as otherwise permitted by law. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive.

8. License and Restrictions

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your own personal, non-commercial use. You agree not to, and not to permit others to: copy, reproduce, distribute, publicly display, sell, resell, sublicense, or otherwise exploit the Service or its content; share your account or access credentials; scrape, crawl, or use automated means to access or extract content; use the Service or its content to train, develop, or improve any machine-learning or artificial-intelligence model; reverse engineer or attempt to derive source code; or remove any proprietary notices.

9. Intellectual Property

The Service, including our commentary, curriculum design, selections and pairings, audio, software, design, and trademarks, is owned by Paideia Live or its licensors and is protected by intellectual-property laws. Certain source texts are drawn from the public domain and are used accordingly; our particular selection, arrangement, commentary, and presentation of those texts remain our intellectual property. Except for the limited license granted above, no rights are transferred to you.

10. Your Content

The Service allows you to submit reflections, answers, notes, and messages (“Your Content”). You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and use Your Content solely as necessary to operate and provide the Service to you (including generating personalized responses). You are solely responsible for Your Content and represent that you have the rights to submit it and that it does not violate any law or third-party right.

11. AI Tutor and Automated Content

The Service includes AI-assisted features that generate responses and commentary automatically. This content may be inaccurate, incomplete, or inconsistent, and it is provided for reflection and educational purposes only. It is not professional, theological, pastoral, medical, legal, financial, or other expert advice, and it should not be relied upon as such. You are responsible for how you use it, and you use it at your own discretion and risk.

12. Third-Party Services

The Service relies on third-party providers for authentication, payment processing, email delivery, hosting, AI processing, and optional device syncing. Your use of those features may be subject to the third parties’ own terms and policies. We are not responsible for the acts, omissions, availability, or content of any third-party service.

13. Acceptable Use

You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with or disrupting the Service, uploading malicious code, harassing others, infringing any right, or using the Service for any unlawful purpose or in violation of these Terms.

14. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAIDEIA LIVE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16. Indemnification

You agree to indemnify, defend, and hold harmless Paideia Live and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

17. Dispute Resolution; Arbitration; Class-Action Waiver

Please read this section carefully — it affects your legal rights. Before filing any claim, you agree to first contact us at hello@sinuous.dev and attempt to resolve the dispute informally for at least 30 days.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court if it qualifies. The arbitration will be conducted on an individual basis.

You and Paideia Live agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and Paideia Live waive any right to a jury trial.

If the class-action waiver above is found unenforceable as to a particular claim, that claim will be severed and may proceed in court, while all other claims remain in arbitration.

18. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws applicable at the operator’s principal place of business, without regard to conflict-of-laws rules. To the extent any dispute is not subject to arbitration, you agree to the exclusive jurisdiction and venue of the courts located there.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service.

20. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Paideia Live regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
